Terms of Service

These Terms of Service are between you and SplashIQ LLC ("SplashIQ", "we", "us" or "our"). By accessing or using SplashIQ you agree to these Terms. If you don't agree, please don't use the service.
Your account
You are responsible for activity under your account and for keeping your credentials secure. One person per login.
Acceptable use
Don't use SplashIQ to break the law, infringe rights, send spam, or interfere with the service. We may suspend accounts that do.
Subscriptions
Plans are billed in advance and renew automatically. Cancel any time; access continues through the end of the paid period.
Your data
You own your data. We process it on your behalf to provide the service, as described in our Privacy Policy.
Text messaging (SMS/MMS) terms & proof of consent
SplashIQ sends service-related text messages on behalf of pool service businesses that use our platform (for example: appointment reminders, technician en-route alerts, service reports, invoice and payment notices, and account notifications). Message frequency varies by account activity. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help, or email support@splashiq.ai. Carriers are not liable for delayed or undelivered messages.
How consent (opt-in) is collected
We only text people who have given prior express written consent. Consent is collected through one of the following documented paths, and it is never a condition of purchase:
- Web form opt-in. A customer or contractor checks an unchecked SMS consent box next to their mobile number on a SplashIQ form (customer intake, homeowner portal invitation acceptance, quote or estimate request, or contractor listing submission). The checkbox is accompanied by the program description, frequency disclosure, "message and data rates may apply", STOP/HELP instructions, and links to these Terms and our Privacy Policy.
- In-app entry by the service business. An authorized user of a pool service company records that the customer verbally or in writing authorized texting for their service account. The company warrants it obtained that consent.
- Customer-initiated messages. A customer texts the business first, or replies START/YES to resubscribe after opting out.
Proof of consent we retain
For every mobile number in the system we store an auditable consent record containing: the mobile number, the consenting person's name and associated customer/property record, the consent status (opted in, opted out, never opted in), the exact opt-in method and the wording of the disclosure shown at that time, the UTC timestamp of the opt-in, the IP address and user agent (for web opt-ins) or the identity of the staff user who recorded it, the account/business the consent applies to, and the full timestamped history of any opt-out or re-subscription. These records are retained for at least four (4) years after the last message sent and are produced on request to the customer, the business of record, or a carrier or regulator conducting a consent audit.
Scope of consent
Consent is specific to the pool service business that collected it. SplashIQ does not share, sell, or transfer mobile numbers or SMS consent to third parties or affiliates for their own marketing, and consent does not follow a customer to a different service provider. Marketing or promotional texts require a separate, clearly labeled marketing opt-in. Opting out of texts does not affect email or in-app notifications, and customers can still receive service without SMS.
Disclaimer
The service is provided "as is" without warranties of any kind. To the maximum extent allowed by law, our liability is limited to the fees you paid in the 12 months before the claim.
